Tesler Case In Jury's Hands

ATLANTA -- A jury is trying to reach a verdict in the case of a former Atlanta narcotics officer who took part in a botched drug raid that led to the death of a 92-year-old woman.Arthur Tesler is charged with lying in an official investigation, violating his oath as an officer and false imprisonment.The jury received the case around 1 p.m.Tesler admitted on the stand that he lied during an official investigation, but his defense was that he initially lied to the FBI to cover for his senior officers.
Tesler said he feared his senior officers would hurt him or his family if he did not stick with the script.Before closing arguments began, the jury asked the judge if the charges were separate and independent from each other, to which the judge said yes.Tesler’s attorney, William McKenney, told the jury to ask themselves, “did the defendant knowingly and maliciously execute the warrant knowing it was illegal?”Tesler’s trial is likely the only one that will be held in the Nov. 21, 2006, killing of Kathryn Johnston, who died in a hail of bullets as plainclothes narcotics officers busted down her door using a "no-knock" warrant.An investigation later found that the drug charge police used to obtain the warrant was false.The two other officers charged in the shooting have pleaded guilty to state manslaughter and federal civil rights charges.
