Soldier Wants New Trial

ATLANTA -- A lawyer for an Iraq veteran convicted of killing a fellow soldier after returning home to the United States told the Georgia Supreme Court his client deserves a new trial.Attorney David West argued Tuesday that the jury that sent his client to prison was never told Alberto Martinez suffered from combat-related post-traumatic stress disorder.Martinez was convicted of stabbing Richard Davis 33 times after a night of partying in Columbus.Davis' body was later incinerated and buried. Both men had just returned from Iraq.
The movie "In the Valley of the Elah" was loosely based on the 2003 case.
