Parents sue MARTA after death of son at station

ATLANTA (CBS ATLANTA/AP) -

The parents of a teenager who was fatally shot by a MARTA police officer last year has sued the transit agency.

The parents of 19-year-old Joetavious Stafford filed the lawsuit Wednesday in the Fulton County Superior Court.

The lawsuit claims that officer Robert Waldo was negligent when he responded to a fight at the Vine City MARTA Station in Atlanta.

Stafford was involved in a brawl outside the station located near the Georgia Dome after some high school football games took place on the night of Oct. 15, 2011.

MARTA officials said a shot was fired and Waldo ran toward the melee then subsequently fired several shots. They said Waldo believed Stafford was armed.

Stafford's family and other members of the community believe the teen was unarmed.

Autopsy results released Tuesday showed Stafford was shot three times - once in the chest and twice in the back.
