State rests in capitol murder trial for accused cop killer

DECATUR, GA (CBS46) -

After putting DeKalb County's chief medical examiner, two other doctors, a weapons expert and a few others on the witness stand, the state rested its case Thursday in the trial of a man who claims he shot and killed two DeKalb County police officers in self-defense.

William Woodard, 31, claims that he didn't believe Officers Ricky Bryant, Jr., and Eric Barker were real police officers when they approached him the night of January 16, 2008 in the parking lot of an apartment complex off Glenwood Road where the officers worked side jobs as security guards.

Woodard's attorneys told jurors on Monday that the "bullies with badges" snatched their client out of a car and slammed him to the ground.

But on Wednesday, an eyewitness gave jurors a different account.

Mark Lefavre was driving a tow truck and was repossessing a vehicle in the same parking lot the night of the shooting. He's now in jail on a weapons charge. He testified Wednesday about what he witnessed

"I saw a gentleman point, shoot towards another officer," said Lefavre. "That officer collapsed. At the same time, another officer was taking a few steps back, and he took a few steps back. I saw his arm come up like he drew his weapon. He never got it past 45-degrees and then he fell backwards and dropped his weapon."

The prosecution asked Lefavre if he saw the officers rough up the defendant before the shooting.

"Did you ever see an officer strike or hit anybody?"

"No, sir," answered Lefavre.

The defense will present its first witnesses on Monday. Woodard's attorneys didn't say when, but at some point, Woodard will take the stand and testify.
