Victor Hill sworn in as Clayton County sheriff

CLAYTON COUNTY, GA (CBS46) -

Victor Hill was sworn in as Clayton County Sheriff on Thursday morning.

According to Drew Findling of Findling Law Firm, by law in the state of Georgia, any candidate-elect who has won an elected seat can be sworn in within weeks of the upcoming New Year.

Even though Hill was sworn in by a probate judge, he still has to win the court battle against multiple felony charges and a possible suspension from the governor.

Hill is facing a 37-count felony indictment that essentially accuses him of running the sheriff's office, during his previous term from 2004-2008, like a criminal enterprise for his own personal gain.

Gov. Nathan Deal's Chief of Staff Brian Robinson said in November, "Once he is sworn in, the fact that he is under indictment will trigger our office to start a three-person panel."

That panel will look at the matter and decide if Hill needs to be suspended while the case is pending in court.

"I'm yet to see a panel recommend that someone under indictment remain in office. They almost always recommend suspension because an indictment is such serious business," said Robinson.
