ATLANTA (CBS ATLANTA) -

The Atlanta Police Department announced Officer Reggie Robinson has been released from the hospital after he was shot on-duty.

Police said Robinson spotted Frank Nance, 20, making a drug deal on Jan. 11.

During questioning Nance ran from officers and opened fire on Robinson.

Robinson is recovering at home with his family.

Nance was charged with aggravated assault, possession of a firearm by a felon, and cocaine possession and is being held without bond.

On Friday Nace's sister told The Associated Press Friday her brother suffers from seizures.

She says officers continued to hit him after he passed out from a seizure.

Police reports say Nance was resisting arrest and that an officer hit Nance in the face with his gun because he feared for his life.
