Alpharetta councilman arrested on DUI charge

ALPHARETTA, GA (AP) -

A city councilman who was charged with driving under the influence while his son was in the back seat denies the allegation and says police had no reason to stop him.

Michael Cross, an Alpharetta City Councilman and attorney, was arrested after a witness told police he was driving erratically in Forsyth County.

Police say they pulled Cross over, smelled alcohol coming from the SUV and saw his unrestrained 7-year-old son sitting in the back seat.

Cross refused to take a Breathalyzer test and told police they had no reason to pull him over.

Police charged Cross with DUI, endangering the life of a child and safety belt violations.

His attorney, Michael Penn, says Cross disputes he was intoxicated when police stopped him and would never endanger
