Judge waives jury trial in Navy kickbacks case

PROVIDENCE, RI (AP) -

A federal judge in Rhode Island will allow three people to waive a jury trial in an alleged kickback scheme that prosecutors say cost the U.S. Navy $10 million.

Judge Mary Lisi on Friday approved their request. She will decide whether the three are guilty in a bench trial that is scheduled to begin in June.

Former civilian Navy engineer Ralph Mariano, of South Arlington, Va., and his girlfriend, Mary O'Rourke, who worked for Georgia-based Navy contractor Advanced Solutions for Tomorrow, have pleaded not guilty to charges including conspiracy, theft of government property and wire fraud. Mariano's father, Ralph Mariano Jr., of North Providence, R.I., has pleaded not guilty to tax evasion.

Three others have pleaded guilty in the case, including the founder of Advanced Solutions for Tomorrow.
