Andrea Sneiderman in court, asked for charges to be dropped

Lawyers for Andrea Sneiderman, accused of conspiring to kill her husband, have asked a DeKalb county judge to consolidate or dismiss some of the charges against her.

John Petry, a lawyer for Andrea Sneiderman, said many of the counts against his client are too vague.

"The indictment fails to notify her what she is alleged to have done," Petry said.

The charges, especially those of perjury and making false statements, are not clearly worded, preventing Sneiderman's legal team from forming an adequate defense, Petry said.

"She is entitled to an indictment that adequately, legally and sufficiently apprises her of what she has to defend herself against and we ain't there yet with this indictment," Petry said

Assistant DeKalb County District Attorney Anna Green Cross contended that the charges are clear.

"The state's indictment adequately, legally and sufficiently puts her on notice of each and every charged she is accused of committing," Cross said.

Cross added that her office does not have to spell out each point of the charges against Sneiderman.

"It is not required the indictment give every detail of the crime," Cross said.

Prosecutors accused Andrea Sneiderman of conspiring with her boss to kill her husband, Rusty Sneiderman.

Hemy Neuman is serving a life sentence for shooting rusty Sneiderman outside a Dunwoody day care in Nov., 2010.

Prosecutors have said Andrea Sneiderman and Neuman were romantically involved.

Andrea Sneiderman, denied she played any part in the murder and denied any relationship with Neuman.

"She lied about her affair with Hemy Neuman and concealed her relationship with Hemy Neuman," Cross said.

"Due process does not allow the state to put a defendant on trial for any defense by guessing what it is she's supposed to have done," Petry Said.

Andrea Sneiderman is scheduled to appear in court again on Wednesday, April 10.
