Double homicide suspect killed in Cherokee County shootout

CHEROKEE COUNTY, GA (CBS46) -

A suspect in a double homicide in Union County was shot and killed by a Cherokee County deputy early Friday morning.

Charles Payne, 59, and Louise Payne,  67, were found dead at a home on Nottely Dam Road in Blairsville on Thursday afternoon.

The couple's vehicle was missing from the home, according to police.

Investigators determined the suspect in these deaths was Charles Payne's son, Anthony Payne, 34.

Deputies spotted Anthony Payne around 11 p.m. on Toonigh Road near Morgan Road.

Anthony Payne ditched the car and ran to 790 Swan Lane in Canton.

Officers said he pulled out a gun and refused to comply with a deputy's command to drop the firearm. The two exchanged gunfire.

Anthony Payne was shot and pronounced dead at the scene.

The deputy was not wounded.

Autopsies are pending at the Georgia Bureau of Investigation Medical Examiner's Office, but preliminary indications are that the elder Paynes died from gunshot wounds.
