Gwinnett County deputies arrested a man for cruelty to children and battery stemming from a domestic violence incident in May.

Deputies were in the process of serving Marvin Bailey outstanding warrants for criminal trespass when they discovered he was hiding from deputies with his children.

While serving the warrant at a home on Satellite Boulevard, deputies could hear children crying inside the apartment.

Philathea Knowles told the deputy that she lives in the apartment and that no one was inside. She denied that any children were inside, according to reports.

Deputies made entry into the apartment using a key from the leasing office.

Once inside, deputies discovered Bailey hiding in the attic with his daughter, 4, and 6-year-old son. A 1-year-old child was also discovered hidden under a blanket in the apartment, according to the report.

Bailey surrendered and was taken into custody without further incident.

Deputies obtained additional warrants charging Bailey with three counts of reckless conduct.

Knowles, the children's mother, was charged with obstruction of a law enforcement officer.

The children were released to a family member who was called to the scene.
