The man convicted of stabbing his neighbor's dog to death, appeared in Oberlin Muni Court Thursday.

The judge sentenced Gerald Miller to 120 days in jail.

Miller had pled no contest to animal cruelty last month.

The incident happened on March 10 at 960 Red Tailed Lane in Amherst.

Miller told Amherst Police he was walking with his daughter and her dog, when he came across a neighbor's dog, who started growling.

Miller said he felt threatened, so he stabbed the dog in her upper back with a folding knife. Maya died en route to an emergency vet.

Robert Danicki is the owner of Maya.

Danicki and another witness stated they never heard or saw any aggressive behavior from Maya.

Danicki saw the incident from an upstairs window.  He further advised the two dogs were familiar with each other and they never had a problem before.  Neighbors also stated that Maya was a very obedient and well-mannered dog.

There were no injuries to Miller or his daughter's dog.
