Ga. man sentenced in tax fraud scheme

Federal prosecutors say a man has been sentenced to five years in prison for filing fraudulent tax refunds while he was behind bars.

Prosecutors say 34-year-old Arnold Tobias Gervais of Marietta defrauded the IRS out of more than $3.4 million in fraudulent income tax refunds.

Officials say he was convicted of filing a fraudulent state refund in 2008 and had been in state prison until 2010.

While he was behind bars, investigators say Gervais either filed or had others file seven fraudulent tax refunds, claiming that he and an acquaintance were owed federal taxes from work at a fictitious company between 2004 and 2009.

Prosecutors say federal authorities seized more than $2.2 million from Gervais and have also ordered him to pay more than $2.8 million in restitution.
