Defense says police intimidated suspect's mother at gunpoint to search home

COBB COUNTY, GA (CBS46) -

Attorneys for 18-year-old De'Marquise Elkins said Glynn County Police intimidated their client's mother into agreeing to let them search her house without a warrant.

Investigator Stephanie Oliver was there when officers entered the home. Defense attorneys asked her why she held Karimah Elkins at gunpoint before asking her to let officers into her home.

"She was not at gunpoint, no sir," Oliver said. "I had my gun pointed down towards my right side. I don't believe she saw my weapon whenever I asked her for consent to search her house."

Oliver admitted to not reading Karimah Elkins' her Miranda Rights before asking her questions, but claimed that she wasn't interrogating her at the time. Oliver also admitted to not having a search warrant to search her house, but said it wasn't needed if she had permission.

Defense attorneys motioned for a mistrial three times Friday – twice in the span of five minutes – but were denied each time.
