Brandon Barnes, 25, faced a Fulton County judge on Tuesday for a probable cause hearing.

Barnes is accused of shooting and murdering 22-year old Mychal Fair at Underground Atlanta on Aug. 12.

The lead Atlanta Police homicide detective took the witness stand during the probable cause hearing.

Det. Scott Bowers said eye contact between the victim and Barnes led to an exchange of words and then a fight.

"A physical altercation takes place, they separate once again after the fight," said Bowers.

Bowers said the defendant was not satisfied with the fight. A witness saw him pull a gun.

"He observed the person he termed as the shooter carrying a bag when he exited the Underground. Outside he saw that individual reach into the bag he was carrying," said Bowers.

Bowers said several people in the area witnessed the shooting. One of those witnesses took action.

"Both the witness and the deputy gave chase of the suspect he saw with the handgun shoot the victim," said Bowers.

Bowers said the witness and deputy caught Barnes.

"When he was detained, there was a gun recovered in his possession," said Bowers.

The victim's parents, several friends and family members attended the hearing. Afterwards, his father was going to speak but changed his mind. The family's attorney spoke for them.

"Out of respect for the family, it's been a long day. The victim's father is not going to speak today. It's a long process, we are in the beginning phase. We're going to dot every "i" and cross every "t" We're not going to leave any stone unturned. We are going to make sure justice is served," said the attorney.
