Tenants were in the dark about living in foreclosed home

ATLANTA (CBS ATLANTA) -

Gabriel Cortez lives with his fiancé and newborn baby in Northeast Atlanta.

They said they've rented this home on Hillpine Drive for more than a year and maintenance issues around the house are actually the least of their worries.

"It's just very worrisome that we potentially could have been out within a month," Cortez said.

Last week, Cortez said a real estate broker showed up at their door and informed them the home they were renting had been foreclosed. So they called their landlord, Christopher Gordon, who they thought was the owner of the property.

"He called us back maybe an hour later and said yes, apparently I lost the house. I did not know this and I do not know what's going on," Cortez said.

So CBS Atlanta News went to the real estate broker in search of some answers.

"When it came out of litigation on July 19, they should no longer have been paying rent to Christopher Gordon," Real estate broker Bru Krebs said.

The broker said this foreclosure deed states that the bank of New York Mellon now owns the home and it will be up for auction in October.

"The last thing we want to do is throw them out on the street. We want to work with everybody, we want everybody to be happy. We understand they're in a bad situation," Krebs said.

CBS Atlanta News also spoke with Gordon and said he was never informed of the foreclosure and now he's trying to reverse it.

"I just don't see how he could be in the dark about something like this," Cortez said.

Gordon also said that he will reimburse the family for any over payments made and the security deposit if he's unable to reverse the foreclosure.

Cortez and his fiancé said they had planned to move at the end of the year.
