Family says wrongful arrest at hospital landed loved one in jail for Christmas

A grandfather arrested at a Portland hospital was released from jail Thursday night, and his family said he never committed the crime of which he's being accused.

Jimmy Brown was booked into jail on charges of domestic abuse and aggravated assault, but those charges were dropped Thursday.

His family is upset that they missed out on Christmas with their loved one and they said OHSU police never should have arrested him in the first place.

Brown was a patient at OHSU, and his illness made him delirious and confused, according to family members.

Earlier in the week, Brown's wife tried to stop him from leaving his hospital room, but Brown became upset and pushed her against a wall, causing her to hit her head.

She told OHSU police it was an accident and she didn't want to press charges, but officers arrested Brown anyway.

She said she's glad to be back with her husband.

"I'm feeling happy, but at the same time, I'm feeling like they robbed me of my Christmas," Susan Brown said.

"They need to look at the person. They don't need to look at the books. If someone at an old folks home were to hit somebody, they wouldn't take him to jail," said Tommy Brown, Jimmy's son.

OHSU issued a statement to FOX 12 on Thursday, saying their officers "are required to enforce state laws in order to keep our patients and visitors safe at all times. Due to the fact that there is an ongoing investigation, we cannot comment further on the specifics of the incident."

Brown's family said they plan to take him home to open presents and celebrate Christmas on Friday.
