Man accused of killing girlfriend's infant cries in court

MORGAN COUNTY, GA (CBS46) -

When Donald Justin Lee, 21, walked into a Morgan County courtroom and saw his family he started crying.

His crying worsened when Judge Connie Holt read the charges he's facing.

"Mr. Lee you understand you have been charged with cruelty to children in the first degree," said Hold.

Lee made his first appearance on Monday. He's charged with killing his girlfriend's 9-month-old son Brantley Farmer.

"You've also been charged with the offense of felony murder," said Hold.

On Saturday police were called to the house on Aqua Lane that Lee recently moved into with the child's mother.

Paramedics arrived and found the baby unresponsive. He was transported to the hospital where he later died.

"9-month-old Brantley Farmer was in the care and custody of the accused," said Holt.

Police said the baby's mother was at work. Lee told investigators the child fell off the couch.

Morgan County Sheriff Robert Markley said Lee lied to investigators.

"The original information that we received is inconsistent with the injuries that we're seeing on the child," said Markley.

Lee's grandfather Donald, who would not tell CBS46 his last name, said Lee was named after him.

"We're concerned about Kristen and her family and we are concerned about Justin. Nobody would want anything like this to happen to their family," said Donald.

Just before the hearing ended, Lee blew his mother a kiss. Lee told the judge he is a convicted felon currently on probation.

He will be back in court on April 17.
