Cara Rintala files motion to dismiss murder charge

NORTHAMPTON, MA (WSHM) -

Attorneys for accused murderer, Cara Rintala, have filed a motion to get the murder charge against her dropped, saying that her right to Due Process will be violated by a third trial.

The Northwestern District Attorney's Office told CBS 3, the motion has been forwarded to Judge Mary Lou Rup's attention. Rup has been the judge overseeing Rintala's trials.

Rintala is accused of killing her wife, Annamarie Cochrane-Rintala, in their Granby home back in 2010.

She has gone through two trials, both of them ending with hung juries.

Rintala was released on bail and prosecutors have said they are planning to go to trial again later this year.

Meantime, the defense claims the prosecution does not have enough evidence to convict their client.  

No hearing has been set yet for the motion.
