CLAYTON COUNTY (CBS46) -

A Walmart truck driver from Clayton County is out on bond after authorities said he crashed into a limo bus which carried actor Tracy Morgan.

Kevin Roper, 35, is charged with assault and death by a vehicle.

Friends said Morgan is showing signs of improvement after the deadly crash early Saturday morning.

The accident killed James "Jimmy Mack" McNair, 63, a fellow comedian and writer for Morgan.

"He always made sure that there were programs for the kids, volunteered his time, a great comedian, a great writer, but very giving," said McNair's friend.

"Devastated. We're devastated. James, I love you," said McNair's wife.

Morgan suffered a broken leg, broken femur, broken nose and several broken ribs.

Roper is due in court tomorrow in New Jersey.

Friends said Morgan will be in a hospital for several weeks.
