Police: Pedestrian killed after darting in front of car

ATLANTA (CBS46) -

Police in Brookhaven say one man was killed and another in critical condition after they reportedly jumped in front of a moving car.

The accident happened shortly after 3 a.m. Sunday on Buford Highway near Briarwood Road.

Police say the two men were walking from a nearby nightclub when the two darted in front of a car driving on the east side of the roadway.

One of the men died on the scene. The other was taken by ambulance to Grady Memorial Hospital in critical condition.

Neither the driver of the car or the passenger suffered any injuries.

Investigators say both walkers were believed to be drunk and crossing the road illegally.

The driver was not found to be at fault and will not face any charges.

Police will release the names of the man killed once his family has been notified.

During their investigation, a man drove around the police barricades. He was stopped by officers. Police arrested Ramon Ramos-Abaka and charged him with driving under the influence of alcohol and driving without a license.

Ramos-Abaka was taken to the DeKalb County Detention Center.
