Argument between two men in Johnson City escalates to shootout, murder

JOHNSON CITY, TN (WJHL) -

Judge John Keiner appointed a public defender to a man who was charged with second-degree murder following a shooting on East Myrtle Avenue early Friday morning.

Moses Ballard, 29, was given a $200,000 property bond or a $100,000 surety bond.

Ballard was scheduled to appear back in court on July 14.

Judge Keiner, who is retired, filled in as judge Monday.

Johnson City police officers are investigating a shooting on East Myrtle Avenue early Friday morning.

According to a JCPD news release, officers responded to a home in the 1400 block of East Myrtle Avenue and found two people with gunshot wounds and they were taken to Johnson City Medical Center for treatment. 

Michael Alexis Lee Rowe, 30, died as a result of his injuries.

Moses Alfonso Ballard, Jr., 29, reportedly had non-life threatening injuries and is expected to recover.

According to the release, Ballard was charged with second-degree murder and possession of a handgun by a convicted felon upon his release from JCMC.

Tonya Sue Hartley, 24, was also charged with aggravated assault, tampering with evidence and possession of a handgun by a convicted felon.

Police said Rowe and Ballard were reportedly arguing and then shots were fired.

Ballard was wounded, dropped his weapon and then left the scene.

Hartley reportedly picked up Ballard’s gun, found Ballard a short distance away and fired shots at him.

According to the release, she then fled the scene, returned later and then was arrested.

An investigation revealed that Hartley hid both guns used in the shooting, which investigators recovered nearby.

Hartley was taken to the Washington County Detention Center, where was she being held on $50,000 bond. She was scheduled to appear in Sessions Court Monday at 1:30 p.m.

According to the release, Ballard is being guarded at JCMC and will be taken to the Washington County Detention Center when he is released from the hospital.

A bond hearing will reportedly be held for Ballard in Sessions Court.

The investigation into the shooting is ongoing.

Ballard was arrested back in 2011 for attempted first-degree murder, after he reportedly shot a man three times at Big G's Bar in Johnson City on Feb. 2.

He also was arrested in 2013 for two counts of the sale of crack cocaine to an officer.
