Family of man shot by Smyrna police officer meets with GBI

DEKALB COUNTY, GA (CBS46) - The parents of a 23-year-old man shot and killed by a Smyrna police officer said they are encouraged after a meeting with GBI agents Friday afternoon.

"It was emotional," said Mawuli Davis, the family's attorney. "Every time they have a meeting like this, they have to relive the process of what they're going through as a family.”

Nick Thomas was shot to death on March 24 after police went to the Goodyear Service Center on Cumberland Parkway in Cobb County where he worked.

Police said Thomas was driving a customer's Maserati and tried to elude them, then drove the vehicle toward officers. That's when Sgt. Kenneth Owen shot into the car.

Thomas' parents, Huey and Felicia, demanded that the GBI get involved in the investigation that is being handled by Cobb County police.

"We've been contacted by different people who said they observed what happened, and that it is not consistent with what has been reported," said Davis.

Davis said he is also reviewing surveillance video from businesses in the area.

Thomas' parents did not comment as they left the meeting at GBI headquarters. Davis said they were too emotional to talk but were pleased with how agents listened to the family's concerns.

"They looked this mother in the eye," said Davis. "That was one of the things Ms. Thomas asked each of them to do, to look her in the eye and to treat this case as if it were their own child."

Davis said he could not say how long the GBI investigation would take but said the two sides agreed to share information and keep the lines of communication open.

The family said the GBI has completed its autopsy on Thomas and they will now begin making funeral arrangements.
