COBB COUNTY, GA (CBS46) -

Day 9: CBS46's Vince Sims is in the courtroom as potential jurors are questioned for the trial of Justin Ross Harris. 

Harris is on trial in the death of his son, Cooper Harris.

Harris told investigators he forgot 22-month-old Cooper was in his car when he went to work on June 18, 2014. Cooper was found dead more than seven hours later.

A little more progress has been made in picking potential jurors for the trial.

Twenty-six people have been qualified as potential jurors. Twenty-two people have been excused for various reasons.

They still need to get 40 to 60 people total.

Once they reach that pool of 40 to 60, each side will still have up to nine strikes to remove people.

Prosecuting attorney Jesse Evans started his day telling one potential juror that Harris is presumed innocent until proven guilty.

"We the state, the prosecution side of things always have to bear the burden of proving a case if we can and if we can't you'd have an obligation to find the defendant not guilty."

Defense attorney Maddox Kilgore is concerned about one person's wife being an influence on him being impartial.

"There is no oath that you can take that is going to get rid of that situation," Kilgore said. "You are going to go home to the same house every day to the same wife everyday to face her knowing what her opinion is right? It's going to put you in a tough position to be fair and impartial isn't it?"

Leanna Taylor, the now ex wife of Harris, attorney Lawrence Zimmerman was in the courtroom today. Zimmerman tells CBS46 Taylor could be called as a witness.

"She knows that when she comes to court she is to tell the truth and she will tell the truth and that is what I will council her on," Zimmerman said. "As far as anything else I don't tell her what to say. She'll answer questions that are asked."
