Buckhead condominium accused of not properly paying water bill

Residents of The Phoenix condominiums in Buckhead first alerted CBS46 to the fact they were paying water fees to the homeowners association that weren't being properly paid to the city of Atlanta.

Community activist and former Atlanta City Council member Derrick Boazman says the city is not forcing them to pay what's owed and he is calling it unfair.

"There is no way in the world that this city council should allow this to happen when you are cutting off water to in southwest Atlanta to poor people everyday," Derrick Boazman said.

Addressing the city council members today, he told them no matter what caused the problem, the money now must be collected.

"You can not have a double standard," Boazman said. "What are we saying if you are not willing to collect the money from the rich, collect the money, put it in a fund and pay the water bill of the poor."

Lillian Govus is director of communications for the Department of Watershed Management. She says no agreements were made allowing the Phoenix to go without paying.

"No decision was ever made with their authority, their leadership and our leadership so the idea that there has been some backroom deal or some forgiveness is just plain not accurate information," Govus said.

Govus added that based upon a full review of the account and water consumption data, outstanding charges will be invoiced and changes are being made.

"We are looking at that account," Govus said. "We are also putting in procedures in place on other accounts so we prevent this from happening in the future."
