Judge denies effort to block South Fulton cityhood vote

FULTON COUNTY, GA (CBS46) -

An effort on the ballot to make South Fulton County its own city was blocked in a federal court on Thursday.

Davis V. Fulton County Board of Registration & Elections sought to bring a temporary restraining order that would cease voting in the referendum for South Fulton Cityhood on the ballot for the November 8 election.

South Fulton resident John Davis, the plaintiff in the suit, alleged that because of the "legal mess" in unincorporated Fulton County, the boundaries of the future city were not defined.

According to Fulton County officials, if the ballot initiative had been halted, it would have been the first time in U.S. history that voting was stopped midstream. 

The case is still pending but, in the meantime, voting will continue.
