Man gets 2 years in prison for attacking wife in argument

MARIETTA, GA (CBS46) -

Prosecutors say a suburban Atlanta man has been sentenced to two years in prison for choking and binding his wife during an argument.

Cobb County District Attorney Vic Reynolds says 59-year-old Daniel LaPorta was sentenced Monday after the jury convicted him of false imprisonment and battery. LaPorta said he wanted to "shut her up" during the argument in 2015 by choking his wife until she passed out, using duct tape to bind her legs and putting tape over her mouth.

The heated argument occurred in their eight-bedroom, four-bath home near the Marietta Country Club. They are now divorced.

Cobb Superior Court Chief Judge Stephen Schuster called the couple's relationship "toxic."

LaPorta was ordered to have no contact with his former wife. His attorney says LaPorta had been in custody since late October.
