McIver's attorneys file motion for bond

Tex McIver's attorney filed a motion for his bond, Monday. Judge Robert McBurney, the same judge who sent McIver back to jail for violating bond, has been assigned the murder case.

McIver's attorneys tell CBS46 they're asking Judge McBurney release McIver without a bond hearing and place him on house arrest. The defense say a hearing isn't needed because Judge McBurney heard two and a half days of testimony during the hearing last week to revoke McIver's bond.

The district attorney's office tells CBS46 it wants McIver behind bars until trial. Judge McBurney hasn't yet signed the motion for bond nor set a date for a bond hearing.
