No matter where you fall on the political spectrum, you should find this news very disturbing.  An ACLU attorney appears before the 4th Circuit Court of Appeals a few days ago admitting that if any other president issued the Trump executive order travel ban it “could be” constitutional!  The courts have issued a stay on the executive order until it can be heard before the Appeals Courts and eventually the U.S. Supreme Court.

As many of us suspected this fight concerning the executive order travel ban is not about the poor refugees and immigrant children from the six countries listed in President Trump’s travel ban, this is about Trump.

This is about Trump’s campaign statements not the text of the order. If the travel ban is wrong constitutionally it should be wrong, no matter who is president.  Is the president acting within the scope of his power, doesn’t the ACLU attorney seems to suggest this?

It is no less than outrageous this order is even being dragged through the courts. Most of the judges on the 4th circuit are appointed by democrats so despite this admission, it probably won’t change the ruling by these mostly liberal judges.  However, it was a republican appointed judge who asked the critical question here so we now have on the record valuable information.

This is significant when you recall Former Acting Attorney General Sally Yates’ testimony on Capitol Hill about her refusal to follow the President of the United States’ executive order claiming the order is unconstitutional.

What we are seeing is contempt for a president so deep and so wide partisan politicians and judicial activists are refusing to follow our constitution and our laws. It highlights the importance of having judges who follow our constitution and our laws and not their political leanings.

The 9th Circuit Court of Appeals will hear arguments on the travel ban May 15th where again judicial activism and not the constitution will most likely take center stage.

However, the ACLU attorney’s admission will have an impact when President Trump’s travel ban goes before the U.S. Supreme Court in the next few weeks.
