Former APD officer sentenced to prison after beating man suspected of stealing tomato

Four years ago, an innocent man was beaten by an off-duty officer and his suspected crime was stealing a tomato.

The former officer with the Atlanta Police Department will spend five years in jail after being convicted of excessive force and falsifying a police report.

"I'm not too easy to cry, that situation made me cry," said Tyrone Carnegay. 

Every moment of that emotional situation is captured in surveillance footage from a Walmart in southwest Atlanta. 

"When I was on the floor and I was crying to him I said why'd you do this man," said Carnegay. "I was just humiliated on that floor."

The man hitting Carnegay over and over again, is former Atlanta Police Sgt Trevor King.  King beat Carnegay until his leg was broken.

"Sometime the scab come off,  if you scrub it too hard it will come off," said Carnegay.

It was because King thought he stole a tomato. Turns out, Carnegay had a receipt. 

"If you would have had a flat screen TV it would have been different, but a tomato," said Carnegay.

That positive attitude has allowed Carnegay to push through two trials within years. 

"I just think they did the right thing for me," said Carnegay.
