Woman claims she was injured during rough arrest

An Atlanta Police officer is now under investigation, accused of roughing up a woman during her arrest at a Buckhead restaurant.

CBS46 has obtained exclusive video of the altercation between the women and the police officer at the Houston's restaurant on Peachtree Road. The women say the officer aggressively pulled them out of the restroom, leaving one with a black eye, scratches, and bruises.

In the video, you see one woman on the ground and another with the officer behind her and her body in the bushes.

Police tell CBS46 the women walked into the restaurant after it was closed, went to the restroom and wouldn't leave. After several requests to get to out, the officer says he grabbed Brittany Lucio's wrist and when she slipped away she punched him.

Attorney Gerald Griggs says that's not the full story.

"At no point do you see them strike the officer or do anything aggressively to the officer but they sustain injuries and they were the ones that were being assaulted," said Griggs.

Houston's parent company Hillstone says it's investigating. But at this point they believe managers handled this correctly.

Hillstone issued this statement to CBS46 News, regarding the arrest:

"We are aware of a complaint regarding an incident at our Houston’s Restaurant on Peachtree Road on May 13th and are in the process of investigating. The evidence we have seen thus far shows that three women arrived approximately 30 minutes after closing time, they went into the restroom as a group after being told that the restaurant was closed, the three stayed in the restroom for more than 10 minutes, and refused to leave despite repeated requests from several managers to do so. Eventually, an off-duty Atlanta Police Officer was summoned with whom one or more of the women got into an altercation that led to arrests.  Based on our current understanding, we believe our managers responded appropriately to this unfortunate situation.

The Atlanta Police Department released the following statement regarding the excessive force accusations:

The Atlanta Police Department is gathering evidence related to the arrests that occurred at the Houston’s Restaurant at 2166 Peachtree Road on May 13th, 2018.  Our understanding, based on the preliminary investigation, is that a restaurant manager approached an off-duty officer, working at the location, and asked him to remove three females from the restroom after they had refused management’s requests to leave.  The officer asked the females to leave but they did not comply and ignored his requests giving the officer no other option but to take them into custody for trespassing.  Our preliminary investigation has also indicated that several of the females resisted the officer’s efforts to make an arrest and there was a physical altercation between them and the officer.

The Atlanta Police Department is aware of the excessive force accusations made by the arrestees and the Office of Professional Standards has opened an investigation into entire incident for appropriate action and whether proper procedures were followed. The Atlanta Police Department takes accusations of excessive force very seriously and will be reviewing all aspects.
